ORDINANCE NO. 10488 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 913 EAST M. L. KING BOULEVARD, BEING ON THE NORTHEAST LINE OF EAST M. L. KING BOULEVARD AT FAIRVIEW AVENUE, FROM R-3 RESIDENTIAL ZONE TO R-4 SPECIAL ZONE, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 913 East M. L. King Boulevard, being on the northeast line of East M. L. King Boulevard at Fairview Avenue. Tax Map No. 146H-M-17 and 18. from R-3 Residential Zone to R-4 Special Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. The development shall not alter the twenty (20) feet of existing yard consisting of grass and trees as measured perpendicularly from the MLK Boulevard public street R-O-W towards the interior of the property except that: a. Vehicular and pedestrian access points to the site (not to include parking stalls) may be provided. b. An access drive for the hearse to serve the front of the church facing MLK Boulevard may be provided. c. Necessary improvements to provide a handicapped access ramp may be provided. 2. The site shall preserve all trees as designated by the City Forester, including an area around each tree which shall remain undisturbed. No vehicles, heavy equipment, or similar heavy materials shall be permitted in this protection zone. In addition, no cutting or filling shall be permitted in this area. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as provided by law.
